Delhi High Court gives reason for not postponing ICAI CA exam, read complete information here

ICAI CA Exam Postponement 2024: A petition by the Institute of Chartered Accountants of India (ICAI) seeking postponement of CA Inter and Final exams has been rejected by the Delhi High Court. The students said that due to the Lok Sabha elections, the examination should be conducted in June and not in the month of May. At the same time, the court has refused to postpone the examination considering the number of approximately 4,26,000 students appearing for the examination.

Let us tell you, in their petition filed through lawyer Alakh Alok Srivastava, 27 students had demanded postponement of the examination, saying that students may face difficulties due to transportation during the Lok Sabha elections. In such a situation, students will not be able to reach the examination center on time. Along with this, students will not be able to study peacefully due to the use of loudspeakers by political parties during the Lok Sabha elections. The lawyer also said that students coming from districts where there is no examination center may face difficulty in finding a place to stay.

While giving its decision, the court said that there is no rule which suggests postponing the examination during the elections. Justice C Hari Shankar’s bench asked lawyer Alakh Alok Srivastava, do you want the CA exam to be postponed? Is there any law which says that no examination can be held during Lok Sabha elections? If you cannot study because of elections then there is no point in becoming a CA.

The court said that the Institute of Chartered Accountants for India (ICAI), which conducts the CA exam, should ensure that the exam dates do not clash with the voting dates and so that students do not face any problem in voting.

While delivering its verdict, the Court said, “The Court cannot cancel the examination to be given by approximately 4,26,000 students merely on the basis of the fact that the students appearing for the examination may face difficulty in taking the examination. The Court is surprised that such a request has been made”

Lok Sabha elections in India are scheduled to be held on 7th and 13th May and no exams are scheduled on 6th and 12th May, so that under no circumstances should the election date clash with the exam date. It also rejected the request of the students that they be allowed to appear only for those examinations, saying that they are not able to appear for all the examinations and that it cannot rework the rules of the examination.

Let us tell you, after the release of the schedule of Lok Sabha elections, the dates of CA Inter and Final examinations were changed. CA Inter Group I exams will be held on 3rd, 5th and 9th May 2024 and Group II exams will be held on 11th, 15th and 17th May 2024. CA Final Group I Exams
Group II exams will be held on May 2, 4 and 8, 2024 and Group II exams will be held on May 10, 14 and 16, 2024. Along with this, the International Taxation-Assessment Test (INTT-AT) examination is to be conducted on May 14 and 16, 2024.

Some time ago, ICAI had said that Foundation and Inter examinations will be conducted three times a year. Till now it is being organized twice a year. However, no information has been received yet about when the examination will be conducted thrice.
